This Privacy Policy explains the processing of personal data when you use this website or send a contact or concert enquiry.

2. Contact and concert enquiries

When you contact us through a form, by email or by telephone, we process your contact details and the content of your enquiry. The contact form asks for your name, email address and message. Concert enquiries may also include the presenter or organisation, telephone number, preferred date, venue and project of interest. Required fields are marked in each form. The date, time and form page are attached to the enquiry to identify its source.

Messages are sent to Nikola Djorić at booking@nikoladjoric.com. We process contract-related enquiries under Article 6(1)(b) GDPR to take steps before entering into a contract or to perform a contract. For other enquiries, the legal basis is Article 6(1)(f) GDPR; our legitimate interest is to process and respond to your message. Your details are not used for a newsletter.

Correspondence is retained for as long as it is necessary to respond to the enquiry or perform a contract. It is then deleted unless statutory obligations or a specific need to establish, exercise or defend legal claims prevent deletion. Tax-relevant records must generally be retained for seven years from the end of the relevant calendar year (Section 132 of the Austrian Federal Fiscal Code, BAO), and longer in cases provided for by law. This period does not automatically apply to every non-binding enquiry.

3. Forms and email delivery

The forms are provided using Elementor. Additional storage of form submissions in Elementor’s submissions database is not enabled for these forms. An invisible form field helps detect automated spam submissions; no external CAPTCHA service is integrated for this purpose.

Email is sent through Site Mailer by Elementor Ltd., Israel. Sender and recipient details, the subject, message content and technical delivery data are processed for this purpose. The service is used to deliver our correspondence reliably; the legal bases described above for each enquiry apply. In the installed configuration, the plugin stores delivery metadata and status information, but no additional copy of the message body in the local delivery log. The plugin provides for these logs to be deleted after 30 days. The delivered email in the recipient’s mailbox is separate from these logs.

Elementor describes processing in Israel, the EU and the USA. Israel is covered by an adequacy decision of the European Commission; for other transfers, Elementor describes safeguards including standard contractual clauses. Further information: Site Mailer Privacy Policy.

4. Maintenance and technical service providers

DAS FORMAT provides technical maintenance for this website. Maintenance, troubleshooting and backups may require access to personal data to the extent necessary. This processing serves the secure operation of the website and is based on Article 6(1)(f) GDPR. Hosting, email delivery and maintenance providers receive only the access required for their respective tasks.

5. Cookies and consent settings

The “Cookie Consent – GDPR & CCPA Cookie Banner & Consent Manager” plugin (Cookiez) manages your selection. The cookiez-user-consent cookie stores your selection and related technical information, including the time and settings version. Its currently configured validity is 180 days. This storage allows your decision to be respected without asking you again on every visit.

The necessary storage takes place under Section 165(3) of the Austrian Telecommunications Act 2021 (TKG 2021). Processing personal data to manage and document consent is based on Article 6(1)(c) GDPR. Processing that requires consent is based on Article 6(1)(a) GDPR. Consent may be withdrawn with effect for the future. The cookie icon on the website reopens the settings.

The cookie banner settings do not currently control the external fonts and media described below. These resources may therefore load even if you have not made a selection in the banner.

6. Fonts

Adobe Fonts is used to display text. The provider is Adobe Systems Software Ireland Limited, 4–6 Riverwalk, Citywest Business Park, Dublin 24, Ireland. Loading font files establishes a connection to Adobe; in particular, your IP address and technical browser and page information are transmitted. Adobe also describes the processing of usage data to provide and bill for fonts. Further information: Adobe Fonts and privacy.

DM Sans is also currently loaded through Google Fonts. This establishes a connection to Google servers. Adobe Fonts and Google Fonts are currently requested directly when a page is opened. No prior consent gate is in place. Further information: Google Privacy Policy.

7. YouTube videos and Spotify recordings

This website contains embedded YouTube videos and Spotify players. Spotify players are embedded directly as iframes and may connect to the provider when the relevant area of the page loads. No prior consent gate is currently in place. When these contents load, the respective providers receive connection data such as your IP address, browser information and the page visited. Playback information, cookies or other storage technologies may also be involved when you use the content. If you are signed in to the provider, it may associate your use with your account.

YouTube is provided in the European Economic Area by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The video widgets use privacy-enhanced mode. This does not prevent all connections or data processing. Further information: Google Privacy Policy.

Spotify is provided by Spotify AB, Regeringsgatan 19, 111 53 Stockholm, Sweden. Information about processing and retention: Spotify Privacy Policy.

8. External links and ticket reservations

This website links to press articles, presenters, ticket offers, social networks and other external websites. Ordinary links open the destination only when you click them. The respective providers are responsible for processing on their websites.

Email links for ticket reservations open your email application. Your message is sent only when you send it from that application. The privacy notices of external presenters apply to reservations made with them.

9. Audience measurement and Google Search Console

This website does not use Google Analytics. Google Search Console is used to monitor how the website appears in Google Search. Simply registering the site there does not embed visitor tracking on this website. Data processing by external font, media and email services is separate and described above.

10. Transfers outside the EEA

International providers may also process data outside the European Economic Area. The applicable safeguards depend on the provider and the specific processing. They include adequacy decisions under Article 45 GDPR and standard contractual clauses under Article 46 GDPR. The linked privacy notices explain the safeguards used by the providers and how to contact them. Consent to load media does not replace the requirements for international data transfers.

11. Your rights

Subject to the conditions set out by law, you have the right to access, rectification, erasure, restriction of processing and data portability. Where processing is based on your consent, you may withdraw it at any time with effect for the future. This does not affect the lawfulness of processing carried out before withdrawal.

Right to object: You may object to processing based on Article 6(1)(f) GDPR on grounds relating to your particular situation. To exercise your rights, please contact booking@nikoladjoric.com.

You may lodge a complaint with a data protection supervisory authority, in particular the Austrian Data Protection Authority, Barichgasse 40–42, 1030 Vienna, email: dsb@dsb.gv.at.

The website operator does not use automated decision-making, including profiling, within the meaning of Article 22 GDPR.
